Two people have filed a federal lawsuit against Sioux City over its ordinance banning pit bulls.
Jennifer Frost and a woman identified as Jane Doe are asking the court to bar the city from enforcing the ordinance and to overturn it as a violation of their constitutional right to due process.
The lawsuit says the ordinance, which took effect in 2009, is inconsistent and bans animals that are not harmful.
Frost was required to relocate one of her dogs outside of city limits because of the ordinance, and the two plaintiff’s each fear other dogs they own may be subject to impoundment.
They claim their dogs have never harmed or acted aggressively towards anyone.
City officials had not been served the lawsuit as of 11:30am Wednesday.
