A POLK COUNTY JUDGE HAS DENIED THE REQUEST FROM PENN NATIONAL GAMING AND THE ARGOSY RIVERBOAT TO HALT THE ORDER TO SHUTDOWN THE CASINO FROM THE IOWA RACING AND GAMING COMMISSION.

JUDGE ELIZA OVRUM FILED HER RULING MONDAY AFTERNOON.

HOWEVER JUDGE OVRUM DID RULE THAT THE ARGOSY CASINO MAY REMAIN OPEN FOR SEVEN MORE DAYS THROUGH JULY 21ST.

THAT IS TO ALLOW PENN GAMING AND THE ARGOSY TIME TO FILE AN APPEAL TO THE IOWA SUPREME COURT.

IF THAT APPEAL IS DENIED, THE ARGOSY WILL CLOSE JULY 22ND.

IN HER RULING, JUDGE OVRUM STATES THAT THE ARGOSY HAS NOT PROVEN THE LIKELIHOOD OF SUCCESS ON THE MERITS OF THE CASE OR THAT IT IS IN THE PUBLIC INTEREST TO GRANT A STAY.

JUDGE OVRUM STATES THAT ALLOWING THE ARGOSY TO STAY OPEN WOULD BE PROLONGING THE INEVITABLE.
